These Terms of Service (“Terms”) govern your access to and use of the Yippee website, creator tools and hosted pages (the “Service”), operated by Yippee Holidays Pty Ltd (ACN 684 828 448) (“Yippee”, “we”, “us” or “our”). By using the Service you agree to these Terms.
Eligibility & acceptance
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it to these Terms.
Your account
You are responsible for providing accurate account information, keeping your login credentials secure, and for all activity that occurs under your account. Tell us promptly if you suspect any unauthorised use.
Your content & the licence you grant
You retain ownership of the photos, videos, reviews and other content you add (“Your Content”). You grant Yippee a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, resizing images), publish and display Your Content as needed to operate, promote and improve the Service. You warrant that you own or have the rights to Your Content and that it does not infringe any third party’s rights or any law.
Acceptable use
You agree not to use the Service to post content that is unlawful, infringing, deceptive, or harmful; to misrepresent your recommendations; to impersonate others; to scrape or overload the Service; or to interfere with its security or operation. Recommendations should reflect your genuine experience.
Bookings & affiliate links
Yippee is not a travel agent and is not a party to any booking, reservation or purchase you make. Bookings and purchases made via links on the Service are between you and the relevant third-party merchant or provider, on their terms. We are not responsible for those third parties or their products and services. Some links are affiliate links — see our Affiliate Disclosure.
Intellectual property
The Service, including the Yippee name, logo, software and design, is owned by Yippee or its licensors and is protected by law. We grant you a limited, revocable, non-transferable licence to use the Service in accordance with these Terms. Nothing here transfers our intellectual property to you.
Third-party links & services
The Service links to and integrates with third-party sites and services (for example, booking partners and mapping providers). We do not control and are not responsible for their content, policies or practices.
Disclaimers
The Service is provided on an “as is”and “as available” basis. To the extent permitted by law, we make no warranties about the Service’s availability, accuracy or fitness for a particular purpose, and we do not warrant that it will be uninterrupted or error-free.
Limitation of liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot be excluded. Subject to that, to the maximum extent permitted by law, Yippee will not be liable for any indirect, incidental or consequential loss, and our total liability arising out of or in connection with the Service is limited to the amount you paid us (if any) in the 12 months before the claim.
Indemnity
You agree to indemnify Yippee against claims, losses and costs arising from Your Content or your breach of these Terms or applicable law, to the extent permitted by law.
Suspension & termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or where reasonably necessary to protect the Service or others. On termination, the licences you granted for content already published may continue only as needed to operate existing links and comply with law; otherwise, provisions that by their nature should survive will survive.
Changes
We may update the Service or these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws in force in [State/Territory], Australia, and you submit to the non-exclusive jurisdiction of the courts of that place.
